    July 05, 2007 - Press Dispensary - Consumers fighting to reclaim money through the courts for unfair penalty charges levied by British banks received an historic boost today, when a St Albans county courticon judge ruled in favour of a claimant, awarding him over £4,000. This is the first ruling of this type to pass through the UK courts.

    Why is the ruling the first of its kind?? Has any one got a link to..........Gregory Terry v Lloyds TSB Plc, or someone post up a link to the a thread on the website he uses.

    I dont think we are allowed to do a link to the other website- and I am not sure why its a landmark ruling if the bank did not attend?

    I think the only reason may be is that with the previous Lloydsicon cases they were saying no breach of contract - where as Abbeyicon for instance admitted this in their defence.

    Did the case say charges are definitely based on breach of contract ?

    We will have to keep reading - again- will my brain absorb any more

    I must admit, I can't see what the difference is between this and other cases that have got to court. Be interested in what you turn up Jansus as you are normally the one to unearth news stories that I see

    A & L - Prelim sent/LBA sent
    Barclays (for my Dad) - Awaiting statements/LBA for S.A.R. sent/Statements received/Prelim sent/LBA sent

    as I thought not really a landmark case -just that it was lloyds that got the publicity for the only cases to lose previously. And still in county courticon so no precendent,And the bank did not appear
