    Default Question

I just want to make sure of something.. if any one can help please..
Can a bailifficon obtain a warrant for your arrest for council tax arrears, and what are the chances of you going to prison for not being able to pay the arrears, not trying to avoid paying.
    Thank you

    Council Tax.

Liability order obtained through court via council, pass it onto bailifficon company, if bailifficon can not get full payment, then it can be returned to council, then council will either obtain arrest warrant or stat demand you (bankrupt you).

simple answer is yes, but its not that simple. but it is an inevitable possibility if you totally ignore them & don't pay 'something'.
council rarely wish to do this as it ofcourse costs more time/money than the arrears are probably worth.

TBH most councils will agree to a repayment schemeicon but it must be realistic & you must keep to it.

how far down the line are you with this?
ie have you talked to the council etc
if you wish help, you need to provide a bit more info.

there has been payments of the council tax straight to the council, its not a matter of not paying its a matter of not being able to pay, but the person in question whose debt this is is trying to pay off the debt, which is about £254 by friday to the council as the bailiffsicon have put on over £200 for their fees, its for a business council tax, which unfortunately due to personal issues has not done very well over the last two years, but is slowly now picking up.

Am I right in thinking that the outstanding will be paid by Friday? If so pay it and then SARicon the bailifficon company regarding the charges. Remember that their charges are not subject to the Liability Order and therefore under not enforceable until they get a CCJ. They cannot use their powers till this is granted.

    SFx

PS If I am wrong on this can someone please correct me!!!

there are set tarriffs that bailiffsicon can charge with regard to Co. Tax.
these amount to no more than about £20 for a visit etc.
[info is on several threads about Co. Tax].

do as suggest pay the Co the outstanding money owed on Ctax, and not the charges.
TBH i would request to see their enforcement officericon [i think that will be their name]
if bailiffsicon are charging excessively high fees which are outside of the agreed levels, i would tell him . they are the ones employing them anyhow.

just out of interesticon, who are these jokers , i bet we know them.
