    Default An interesting one......

    Ok. What sort of trouble can a school expect to get for "losing" a stundents school file? I understand this could be a breach of the DPA. A solicitor reqested the file only to be told after 40 days that it has "vanished" Thing is i dont think he made a DPA reqeust. I think he reqested it under a different regulation, the Education (Pupil Information) Regulation 2005. Would i need to make a full DPA request before the Information Commissioner's Office could get involved?

    What sort of file? I dont know any schools that keep paper ones these days so if it truly has been lost then I would imagine data loss is the cause rather than actual we've left it somewhere loss

    Not that that makes things any better though

    Its my GF's old school record. They contain any information on anything that happend to her at school. They are supposed to keep them for 7 years and they should still have hers. We contacted the school and they said all the files for the students from her year are still there apart from hers. The problem is the file would contain information that could be damaging to the school so we are thinking it may have been lost for a reason. The ELA say the school must have this record or they must have records of any requests to have the file moved, but the school doesn't have anything at all.

    I think it's actually a Freedom of Information Act request rather than Data Protection, if memory serves. Certainly, the special needs parents I know have got info from school and LEA with the FoI, not DPA.

    Happy to be corrected if soemone knows otherwise.
