Reply to Barclaycard non compliance letter.. Now what ????
Heres the letter i received from Barclaycard today in reply to my Non Compliance Letter from the CAG library.. Any suggestions please....
Dear Mr T.C.......
Thank you for your letter dated 16th June 2007
Firstly i would like to address your point concerning the provision of a list re charges applied to your account. Unfortunately our system does not have the facility to down load a list outlining charges however, we do provide customers with copies of relevant statements on which the charge is shown. As stated in your letter you have now received these statements..
In regard to your mention of "manual intervention", the Data Protection Act does not oblige the bank to comment about internal policies and procedures. Whilst aggregated information is retained for statistical purposes, this would not constitute "personal data" under the Data Protection Act and therefore would not be covered by section 7 S.A.R - (Subject access request). For the avoidance of doubt, the fact that we do not generally record information in a way that is caught by the provisions of the DPA, is in no way a admission that there was no such manual intervention.
If you require full subject access details please advise me in writing and i will provide these to you.
Yours Sincerely
Sqiggle Squiggle

All i want is my statements going back to the opening of my account(s), and not just the last six years..Unless there is something that i can do here to help everybody elses claim.....THANX
Re: Reply to Barclaycard non compliance letter.. Now what ????
I sent my S.A.R - (Subject access request) x2. Paid £20 (didnt realise) they sent my cheque back, i sent it back to them with a "YOU WHAT" letter, have received 4 copies of statements on 2 accounts, all incomplete, all with months missing, have purchased a new recycling bin off the council, am down to my last wall to bang my head against...I just dont know what to do now....
Am i wrong or does the limitations act (6 years) apply to the Data Protection Act SAR....
Am i barking up the wrong sky scraper...
Re: Reply to Barclaycard non compliance letter.. Now what ????
You need to do some reasearch on claiming more than 6 years. I will try and find some links for you later.
(I didnt realise you were going for longer than 6 years sorry)
Re: Reply to Barclaycard non compliance letter.. Now what ????
At Mo, i just want to get all the information that i am entitled to, and have paid for....Do you know if the limitations act applies to the SAR request.
Re: Reply to Barclaycard non compliance letter.. Now what ????
I received a " Full Data Protection Act Disclosure " from Barclaycard today. Its about 600 pages long, i stopped counting at 500....
2 points really.
They destroy statements longer than 6 years old, Is this true ?.
I still dont have a full set of statements ( none were sent in this ).
A bit at a loss now really.
Any suggestions welcome. ( good or otherwise )
Re: Reply to Barclaycard non compliance letter.. Now what ????
I sent off lba way back before Noah last used the ark...Cashed cheque, sent 4 lots of statements, over many weeks, all incomplete, cant make up a full set..
They are Very Very clever at stalling tactics to their advantage..
Will have a good read at weekend...Dont see the point of non compliance via court as im only a few statements short, really wanted 20 years of statements, not allmost 6.. Will post again over weekend... Thanx for help so far...

Would you believe the day before i file for non com i get a full set of statements for the last 6 years. I kid you not.
This is the paragraph that gets me.
This information we have enclosed relating to this account is all we hold.
They are saying they have no copy statements on me, microfilm, or otherwise, beyond April 2001. Im sorry, i just DONT BELIEVE this.
