    Default Just going to start Claiming my charges back.....may need help

    Hi all,
    Just about to send my first letter to Alliance and Leicester to claim my bank charges back. I wonddered if I can still do this as the balance on my account has got to £1066.51 overdrawn due to excessive charges being levied to my account over the last 4 years.

    I cancelled all direct debits, standing orders etc some weeks ago and stopped using the account, but did leave the account open.

    Yesterday I received a letter from them to say they have decided to withdraw banking facilities and end my agreement under the conditions of use on my account.

    They go on to say "the account is currently overdrawn by £1066.51. interesticon and administration charges will be added and shown on my next statement".

    The letter continues to say that I have to make full and immediate payment to clear the amount and if they do not receive it they will take further steps to recover it and a charge of £15 will be raised to my account toward adminicon costs.

    They also say that they will notify a credit reference agency in 28 days time and that this could affect my ability to obtain credit elsewhere.

    I really would like some help and advice as to whether I will still be eligible to claim due to them sending me the letter and my acoount being overdraen by so much.

    Welcome to the CAGicon jaxsterlady, if you can afford it pay the £1,066.51. This will leave you to devote your resources pursuing the A&L through the CC for recovery of the unlawful charges.

    If you cannot then you have to dispute this account with the A&L. The balance is in the red solely because of accumulated - unlawful charges levied on your account, so follow the tried and tested method used by the CAGicon members.................

    As far as I am aware as soon as your PRE-LIM letter is sent, your account is "in dispute". The important part is that the A&L should not then pursue you for the alleged dept (£1,066.51). Now they may still do this. This happened to me, two separate collection companies were harassing me but I was able to stop this by using this..................
    Protection from Harassment Act 1997

    and various phone callsicon to the A&L legal dept (they WERE very helpful when I told them my account was in dispute)

    Thanks for the help and it's good to know your all there to help. I've sent the letter off and will try to pay the outstanding overdrafticon in full so that I can concentrate on getting the charges made to the account back.
