Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I intend to claim back my charges from A&L, only about £180 but worth it. However, the biggest thing is that they have put a notice on my credit record about overdrawing on overdraft/late payment. I don't know if this constitutes a "default notice" as I'm not up with the jargon. Has anyone had this before and what is the liklihood of A&L removing this since its been caused by the bank's unlawful charges putting me over the limit in the first place?
The money bit is straight forward and I see lots have been refunded but what about a default?
I had second thoughts about claiming my money backsince the bank is closing accounts and I have a large overdraft and a family to support on just my salary. My credit record is not good now (was excellent before I changed my accont to A&L) so I'm worried I don't get another account...............do banks bother about credit records for current accounts?

Yes. If your credit record isn't squeaky clean you probably won't be able to get a standard currect account with a cheque book and overdraft etc.
You should however be able to obtain a more basic current account, for example the Natwest Step Account which comes with a debit card. Other banks offer similar 'basic' accounts.

But as that won't cover my overdraft I'd be stuck owing A&L £1000 with no way of paying it if they close my account! Isn't that what would happen if I claimed my money back and they closed my account?
They may well remove the default notice but it wouldn't be in time for me to clear my credit record and get a new current account with enough overdraft to pay off A&L! If someone else has been successful with this I'll know what to expect.

A&L will close your account.
You would be better off trying to open another account elsewhere. A late payment marker is not the same as a Default which will show up as an 8 or a D on your credit report.

Thanks Tinkerbelle,
I have been thinking about opening a new account but as my last couple of requests for a 0% credit card have been denied I thought it would be a waste of time and end up looking bad because of more searches on my credit report. I'll look around for a new account ASAP,
thanks again
