    Default Deposit on used cars - refundable?

    I recently went to Arnold Clark to buy a Vauxhall Zafira (my criteria was up to one year old with lowish mileage)but the model I wanted was not in their stock. They did have one in another location and they stated that they could arrange for the vehicle to be brought over for me to view. They asked for a deposit of £200 to show that I was genuine. I asked if the deposit was refundable if I did not like the vehicle for some reason and was told that it was if, for some reason, the vehicle was not acceptable.
    I went to the dealer the following week to view the car and discovered that it was scratched on a couple of panels and the interior was a mess. I stated that I was not happy with this vehicle and I did not feel it represented the quality that I would expect from a vehicle of the age. I asked for my refund as promised but was told that I was not entitled to this as they had spent money transporting the vehicle to them. I pointed out that they had told me that the deposit was refundable if I was not happy with the car and thier response was that, in effect, I had agreed to buy the car and that was the end of the mattter.
    I have written to their customer services dept who have responded in a similar vein. Can anyone tell me where I stand.
    PS I have now purchased a Zafira form another dealer in very good condition.

    Did u sign an order form that stated the deposit was not refundable, if you did then u have lost the money, if not they cannot hold it.

    About a year ago, my son started to buy a used car. These are the facts as I understand them:

    1. He put 700 down against the 7000 price.
    2. The seller sent the car away to have some engine work done. My son was aware of this, and expected it to be available in 2-3 weeks.
    3. After the engine work was done, other problems with the vehicle were identified including transmission and other problems. This was before my son took possession or paid additional money.
    4. My son decided there were too many issues with the car and asked for his money back, and the seller refused. Several attempts since that time have all been refused.

    Does my son have a legal claim to get his money back? I assume this will take a Small Claims Court suit.
