Hi everyone, can you good people out there give me some pointers on preparing my cdourt bundle, due to start MCoL next Tuesday (3rd July), and want to try to get as much paperwork prepped, also from the date of the initial claim for refund of charges, can I also add on interest?
Next question - I've been onto the Abbey's terms & conditions site, does it matter which T & C's I download to put into my bundle.
Also after lodging MCoL what kind of time scale is there for receiving a court date.
I wouldn't worry about a court bundle just yet it is a while off you needing it. It seems to me that you are at the beginning, hope thats right I don't want to sound patronising . If you have all your statements for the last six years on your account great, if not you need to send a Subject access request with £10 to get them. There is a template letter in the help files.
I also suggest that you read the help threads first it is extremely important to follow the right steps all the way through!!! Read as many different threads as you can including those who have allready won and then read some more it's learning by fun, trust me . If you don't know or aren't sure do not be afraid to ask, everyone will help you, they are great people.
Yes you can add interest on your charges, there is also a spreadsheet which calculates it all for you, the statutory rate awarded by thee court is 8%.
I believe you idealy need the ts & c's from when you opened your account, most are available on here as well.
Timescales... ....it can take months , my case is 4 months in now and I haven't got a court date yet, the best thing to do is follow the help threads and ask.

I'm actually at stage 3 of the process, having done the original, letter asking for money back, then next letter giving another 14 days, so next Tuesday I start the MCoL process, also I opened the account with them over 20 years ago (I know -SAD). I am keeping to the time scale laid out, and all correspondence has been sent by recorded delivery, the only other thing I need to know is, I have been sending letters to the address on the top of my statements, and have noticed people qouting another address, which is also in London, should I send letters there instead?
One more thing, if Abbey have taken more charges since initial request for refund, can I also add these to the claim.
Regarding the address question, I replied to the address on the letters from the Complaints Dept. that I received in relation to my requests. As far as I am aware the letters get re-directed to the appropriate departments anyway.
You will have to use the Triton Square address on your Court papers, though, as that is the registered office.
Regarding the additional charges, yes, you can add them on right up to the date you file in Court.
Sorry, I just wasn't sure, with it being your first thread.
I would still say don't worry about the bundle just yet, I know it is always tempting to get things going but unless Abbey change their ways, it is likely to be a fair time before you need it, I am not saying don't research it and download the documents you need, just don't print it and put it together yet.
Usual thing is you submit your claim, they have 14 days after about 12 or 13 days they respond with an acknowledgement of service. This gains them 28 days from date of service to file a defence. At some point in that time they will send you their defence and the court will respond by notifying you of it and probably an order for the transfer of the case to your local county court. They will probably dispence with the Allocation Questionaire at this stage, it is then up to the District Judge from your County Court to decide whether or not he wants one completing.
Either way it more than likely that it will be a long wait for a date for your hearing, although you may get lucky.

Hi Sparky, I'm a little ahead of you in the Race....I have had mine transfered to my local court and it went before the district judge on Monday. as of yet I have not heard anything. When Abbey sent in they defence they also sent it direct to me with a settlement offer of 65%. I refused........ Will keep you informed of my progress and will keep looking on your thread....Where are you based

Good on you kid stick to your guns, I'm sick of the way they try to kick the little guy, most of the trouble I've gotten into is because they keep taking the bl**dy charges out of my account, even Dick Turpin wore a mask when he robbed people!
Hi,im panicking now.I have just arranged my mcol and ive put the address which is on my statements etc (prescot street)what will happen if i should have put the other address that people are using.
Also how do i find out exactly what should be in my court bundle?
Plus im not sure exactly when my account was opened,probably 18 yrs ago or more.HELP PLEASE!!
