Hi, can anyone advise me on next move with Alliance & Leicester, unfair charges total £3,000 - on 2 occasions they have written to me offering a poxy £460 - My problem is that im based in NI and small claims court only award max of £2,000 - and Ombudsman will take months to settle. Do you think it is worthwhile speaking to solicitor and try to take it to county court? Any advice would be very much appreciated.
Thanks
hi vicky, not sure of the legal situation in ni, but write to a&l or their solicitors and tell them that as the case is to high for the small claims you are minded to have the case listed as "fasttrack" and that their could be significant costs for both sides. just call their bluff. first of all though proceed with your claim and you may find that the case is allowed to remain in the small claims system on the grounds that you are an individual against a large plc. also the courts are getting sick and tired of banks messing the court process up and i think are starting to favor the claimant.
