    Default abbey woes

    have looked at this site and it is great
    Here is my dilema sept 2005 i made a complaint to abb** complaining that they charged me 39.00 for being over drawn 20p for 24hours before the cheque cleared, they refused to refund it months had gone on i sent a letter of complaint they sent me a letter back nothing was resolved i spoke to the FOA they said i had case next thing thing i know i am looking at re-claiming over £1500 in bankcharges, a year and a half had past and i was still waiting March 07 abb** through the FOA made an offer of £672 for this to all go away (in that time they had closed my account and added a default against me ) i refused the offer on the the fact that they needed to remove the default because as far as i was aware it was unlawfully added because my case was still going throug the FOA.. to cut a longer story short i decided to take them to court abb** filed a defence and i am now going to court on the 29th of June i am slightly worried because i have not heard anything from Abb** after they sent me the defence

    Hi Rudibo, as your court date is very close, you should consider contacting Abbeyicon via email to request a settlement. Send your email to Inga.Kirkman@Abbey.com or Louise.Jacobs@Abbey.com point out that your court date is 29th June and let them know your total claim including interesticon, court fees and your costs (as I presume you have already submitted a court bundle) you are entitled to claim £9.25 per hour preparation time (30 hours seems reasonable) plus extra for postage costs, paper, ink etc. Usually they will respond very quickly in cases like yours and agree to settle for the full amount but you might need to haggle a little to get your full amount, if you hold out though you will get it! All the best.

    james i have not sent a court bundle!!! do you mean sending my evidence to the court 2days before the court date also i was not a OA form because they said that it was not needed in this case

    That's fine if you only have to submit papers 2 days before court date, usually the judge asks for bundles to be in 14 days before court date, that was why I thought you would have sent it in by now. Even if you haven't sent it, you have probably spent a while on it already preparing it and you could add these costs on too when you request a settlement. Hope this helps!

    Thanks for your quick response

    i recieved the court date notification on friday the 22nd of June !!!!!

    i have my statements, i have collated all the charges and all the correspondance that i have recieved from Abbeyicon and FOA regarding my complaint/claim and also the offer that Abbey made via FOA which i will be sending tomoroow recorded delivery to the court , however i will be sending an e-mail to abbey as you suggested, I am still worried because i have not heard anything from since they sent the defence, which was a standard defence letter, Once i recieved there defence i wrote them a letter that i will still be pursuing the claim stating that how could they say that i was not liable for any monies claimed when they made an offer via the FOA, i never got a response from them, anyway thanks for the advice and i will let you knowe the outcome

    Hi James33 i took your advice and i e-mailed Inga @ Abbeyicon i told her that my court date was the 29th she responded immediately and stated that She did not have a clue about this and asked me to e-mail the court details because they have had such a backlog..she said she would atempt to make me an offer i wish i did not e-mail her now because i would have gone to court and won outright,

    anyway its 13.39 i will await her response

    Inga replied and directed me to a claire flectcher she settled my claim and said the settlement letter will be posted and if my account is closed a cheque will follow within days, I am elated that this happen but i am a bit aprehensive because even though my account is closed i still owed Abbeyicon money which i am paying of via debt agency so i am worried they are going to pull a fast one and offset amount i have claimed back with what i owe them, as this happened to anyone

    WOW! I'm so pleased for you Rudibo, well done!! I'm sure that if your account is closed, she will send you a cheque like she said - as for using some of the money to pay off an existing debt with Abbeyicon - given that she didn't even know about your court date, how likely is it that she is fully aware of your debt to abbey? Hope you get ALL your money very soon and congratulations again!
