Hello All , great forum you have here and lots of knowledgeable people ,so thanks in advance ....
so i received the standard reply letter on the 7 June stating the A&l dident agree with the bank Ombudsman findings and that they only apply to credit card charges (my claim is for current account charges !) but they are willing to offer me a Full and final settlement of £329.50 in order to resolve the matter ,since my original claim was for £2000 + recent charges since sending the letter and with no interest added (yet ) .my question is do i accept this money but not in full and final and peruse small claims for the rest ??
also there seams to be a lot of £25.00 charges on my account for ..Paid Item Charge ,can i include these in my claim as ,from the wording in the letter A&L say the charges the ombudsman are talking about are only unauthorized o/d and failed standing order charges !?? is this correct ??
Thanks again mark

If they've offered money in 'full and final settlement' can it be accepted as a partial settlement? Maybe if you tried this they'd just withdraw the offer. Not totally sure of my ground on this one, though, so maybe someone else can offer an opinion.
As far as 'paid item charges' are concerned, these are reclaimable.
According to some posts I've read recently, A&L have now "changed their policy" and are refusing to pay out for "Paid Item Charges". I included these in my claim (not yet settled) and would still recommend others still do so. I don't see how they can suddenly change their minds.
Like younganfree, I'm not sure about the Full and final settlement thing ... I'd hold out for further advice on this one.
thanks pepl ! i am just about ready to go down and reg my claim so i will include the paid item charge in my claim for now ,and rject the offer from them ! cheers for the advice mark
Yes I have left the paid charge fees on - and asked them to provide a Breakdown of how they arrived at heir figure to see if they had deducted paid charges - guess what they did not reply

A&L defence from OIL WRAGGE "quote" the only charges relevant to this claim are those which have been debited to the claimant's account within these three charge categories
paid item
failed transaction
unauthorised overdraft
and i believe most of us recieved the same copies of the defence. Now they say i can only claim failed transaction fee, whats the point of having a copy of the defence if they don't stick to it
Dont ya just love the way they make it up as they go along and since when do THEY decide what WE CAN CLAIM !!
I would really like to charge them a ridiculous amount of interest on what they have taken from me ,just for all those times when on a limited income they have taken Half of it in charges .....Makes me so angry i am determined to get every penny back both now and in the future if it happens ! Greedy bast*rds !

PRECISELY!
'Paid item charges' have been fair game since all this 'right to claim' stuff started. The banks just like to rattle their sabres now n again; it makes them believe they're the ones in charge - poor, self-deluded banks.

Are you going for compound interest? This would really inflate your claim
