I've just completed my N1 and intend to file at Court on monday. Six of the £25 fees I'm reclaiming for are overdraft fees, - three of these are just called 'Monthly Overdraft Fees' and the other three are called Unauthordised overdraft fees. I'm now having a moment of doubt as to whether I should remove the 'Monthly Overdraft Fees' from my claim. If the Bank argues I'm not entitled to claim these would the whole claim be thrown out? I'd rather take them out and reduce the claim by £75 than risk all of it.
I filed my claim last month in the local county court and everything seemed to be going along as expected....had the claim form back sealed etc from the court. Wragg and co then wrote to notifty they intend to defend - not panicked by that as I know it's standard. However, out of the blue I've received a "General Form of Judgement or Order" stating that "Upon reading the file it is ordered the case be transferred to the Cardiff County Court". Does anyone know what this means please?
I'm sure I've read of someone else's case being referred to Cardiff court recently, though I can't recall why this happened and what the outcome was (not much help I'm afraid).
All I can suggest is that you give your local court a ring to find out what this means. Is Cardiff fairly near to where you live?
Hi DG....don't panic. Lots of claims are being listed in Cardiff for 14th August. These are directions hearings and is a strategy the courts are using to prut pressure on the banks to settle sooner. There are apparently 300 - 400 of us all on the same date - 14th August at 10.30 - clearly they can't hear us all, they - don't expect to. Check out my thread, and Welshbaba 's and others. Some of us met up in CArdiff yesterday for moral support ( and a quick drink !) But do not panic - this is good news that you are to be added to the list OK ? The General From of judgement order will probably have said you can submit your opinions on how the hearing should be conducted, and/or attend. You can do either or both. I have done both. Will post link to what to say if you want to submit something..it is called "A draft order for Dricections" You might find it on one of the threads before I do .... I am a bit slow. !!!

Thanks Jenny and Mostyn, that's a huge relief - I thought I had been singled out for special treatment which sent me into a blind panic! The order doesn't say anything about directions hearings or even give a date - just that it's being transferred to Cardiff. I'll give the court a ring in the morning to find out why it's been transferred and when I can expect more information.
Mostyn - thanks so much for taking the trouble to include the link to the thread but it's not working. I'm sure I'll be able to track it down though. I'm going to have a look at your thread now and will be following your claim with interest.
