I'm helping my brother to claim back his charges from Barclays bank and have today received a court date through the post for 29 June.
I'm going to write to the courts asking for the date to be adjourned as i was advised to do (by bankfodder) with my HSBC claim as they haven't given me enough time to prepare all the documents (which have just offered full settlement ) but was just looking to find whether barclays pay before court.
I'm a bit concerned because the only name mentioned on this Notice of allocation to the small claims track (hearing) is DISTRICT JUDGE COOKE (i'm claiming in Birmingham BTW).
Just a little nervous for him and after words of encouragement / advice really please.

So what do you recommend, my bro has had nothing to do with this at all and obviously isn't in a position to call. So i'd like to email him back. Any suggestions?? thank you
I realise from your defence that you do not agree with my legal analysis that the charges levied to my account amount to penalty clauses and are deemed unfair. I do however recognise the fact that the sum at issue between us is relatively modest and as such, it is not cost effective for either party to take the matter to trial.
Therefore in order to avoid the inevitable time and cost associated with pursuing the claim to trial (date set for 29 June 2007), I am willing to settle the claim upon repayment of the charges applied to my account, together with statutory interest and costs totalling £3678.21
Only once in receipt of cleared funds will I then discontinue all action against Barclays in connection with this claim.
I have attached a schedule of my charges for your reference.
No reply from Dino on Friday night, but on Saturday morning the postman bought a nice surprise. There's a settlement offor of 3258.61 which he's going to accept.
It's about 420 short of what we were claiming, but 415 of that is older than 6 years so i don't think it's relly worth fighting for tbh.
