Default Claiming over £3,000 from Lloyds TSB

Hi All. First, let me say, well done to everyone who are doing their best to give the banks what they deserve!

Now, to my question. I have worked out that Lloyds TSB over the last 6 years (thanks to them giving me the statements) has charged me £3,000 including 8% APR. I have been reading the posts about claiming from Scotland and am a bit confused. I don't want to go about it the wrong way and need to be sure of what I am doing as it is new to me (and lots of others in a similar position). Do I send the letter and start an online claim if they reject my request (likely!), or use another way. I looked at the Lloyds TSB site and they are two companies each registered in theirs respective countries. Does that mean it will be harder to get my money back? If you take a look at

Any help greatly appreciated.

You should be able to choose where to lodge you claim. For simplicity sake I am helping a friend claim via English courts even though he lives in Scotland and opened his account here. This is mainly due to the claim being nearer 3k and it isn't a Scottish Headquartered bank. Anyway, it's already been done. Lookat Robertxc 's signature line. We won't be able to use moneyclaim online as English Adress required but it can be done by post - not exactly a hardship.

Default Ready to send LBA to Lloyds TSB

Hi all. Just letting anyone interested that I am sending a LBA letter to Lloyds TSB. I have worked out that I am due over £3000. I hand delivered a Data Protection Act letter to my bank (FAO Bank Manager) and received all the necessary stuff to allow me to work it all out. I then hand delivered the request for charges to my bank manager. This letter was passed to the Customer Recovery Centre in Birmingham. The assistant manager signed it but the letter looks like a standard 'get lost' template with a tailored introduction about my request.

Anyway, no matter to me. Now I can send the LBA letter and see what comes of it. I am very prepared to spend £39 for each chunk of £750. I suppose once you get one chunk back then it will be easier to claim for the next chunk - especially as you will have a bit of money to pay the £39!

One question though - I have read in previous posts that a bank may put 'full and final' on the initial claim. What is the best way to play it if it happens? I dont (and everyone else) want to screw it up because the bank got one up on me.

One final thing - Robertxc is the man when it comes to helping out in this forum. Looking at the posts, his help has been invaluable and his confidence helps us to keep going and follow through what might have ended up as a pipe dream. Thankx

When you accept their settlement of each claim, write your own acceptance letter, which accepts their offer "in full and final settlement of this single claim only." Go on to say that you reserve the right to make further claims if and when it becomes necessary.

Oh, and I agree, RobertXC can be moderately useful

I would add to that that you might want to consider politely declining any confidentiality agreement they may try and thrust upon you.

Default larssonn v Lloyds TSB

Hi all. Thought I would let you know that after the bank refusing on two occasions to refund the full amount - over £3000 - I have downloaded the small claims forms and paid my £39, suing for just under £750. This was done Monday 19th June so I need to wait for a copy of the summons.

I handed in forms 1a and 1b but the clerk at the small claims office said that form 1a is for suing a person and 1b is for suing a company, and advised me to hand in 1b only. Once I get my money back for the first lump, I will put in my next claim.
