Default Reclaim charges from BOS

Hi, is it possible to reclaim charges for the following instance

* I was charged 39 pound twice because i didnt have enough money in my account to cover a savings transaction . Because it took 3 days i had taken too much money out of my account and when ING Direct tried to take the amount i had specified there was not enough in my BOS account so the transaction was referred and i got charged my BOS

Hope this makes sense and any replies are greatly appreciated

thanks, NuttyP

One other question

"When i send the request including the £10 fee to the address which your bank has registered with the Data Protection Commissioner as the address of the Data Controller"
Is this the correct information for Bank OF Scotland

Registration Number: Z7828948
Date Registered: 17 April 2003 Registration Expires: 16 April 2007
Data Controller: BANK OF SCOTLAND

Address:
THE MOUND
EDINBURGH

Hi John, i phoned yesterday and they gave me the address of there risk/claims department. You have to send a cheque/bank draft made out to HBOS asking for all you charges to be sent to you.
I do not have the address details on me but will post them once i get home. good luck

Best to ask through Data Protection as they are legally required to hand this over. They (well Halifax) bummed me around when I asked for mine and then sent them when I called well after the 40 days were up

I went the Data Protection Act route, and they turned up in 2 batches about 15 ans 20 days after I asked HBOS. I'd recommend the same way.

I got the following addresses to send the first letter to from BOS staff.
Not sure which one is correct or if i should just send it to the Mound address ?

1.
HBOS PLC
Business risk-retail
10 Carlton Street
Halifax
HX1 2AL

2.
BOS
Customer Relations
PO Box 29112
Dunfermline
KY11 2ZX

Not sure which one to send the data request letter to so any help would be appreciated.

BTW - The most recent charge was put back into my account.

I sent my request for statements to,

BOS
Customer Relations
PO Box 29112
Dunfermline
KY11 2ZX

Send it registered as well and keep the stub. They have 40 days from receipt of the letter. You can find out on the royal mail website exactly when it is delivered using the stub.
