Default Going To Small Claims Heldpneeded (in Sctland)

I Sent Off My Lba Yesterday Only To Get A Final Letter From Ltsb Stating They Will Reimburse Me Nothing As Their Charges Are Fair.i Phoned My Local Court And I Am Going In Tomorrow To Get My Small Claims Form ,my Claim Is £745 Incl Interest ,i Have Been Going Around In Circles Today On These Forums Trying To Get The Best Info For My Application,any Help Would Be Appreciated.i Cannot Believe Ltsb ,they Are Obviously Not Even Interested In Giving Offers Now They Are Obviously Trying To Put People Off ,well For £35 For Small Claims I Am Not Giving In .i Called Ltsb Today And The Guy Told Me To Take My Claim To Court As They Will Not Respond To My Lba

There is a thread here called something like 0000olliebean0000 (from memory). He is in the Scottish jurisdiction and is at the court hearing stage. I would advise you to read all through his thread and if you have not done so yet, read all the links given by Rooster above.

Hi Javorb,

Like Upton says look at all the links that Rooster has posted, you will find just about all the info with regard to the process you will go through at the court stage.

Have a look throught my thread also from when I started court proceedings and this will give you an idea of what you should be looking at submitting, what the court expects from you and what LTSB may try and do. I have made a couple of errors along the way so its all in my thread and you can get an idea from there.

If you need any further help just ask, are you aware there is a Scottish forum also, its under general it will be of use. To be honest I would just say read as much as you can, knowledge is a powerful tool.

If you want to PM me I dont mind either.

Court return date 20 October 2006 - LTSB did not reply,
Court hearing date 27 October 2006 - Decree granted in my favour,
Recall of decree recieved 16 November 2006,
1 December 2006 assigned as recall of decree,
26 January 2007 assigned for full proof hearing,
16 January 2007 1st offer recieved and declined,
23 January 2007 2nd offer accepted, awaiting monies to hit bank account
