Default Another Newcomer seeks wisdom! (HBOS)

Alright Folks,

Been looking into getting my charges back from HBOS after reading Martins MSExpert site. I was referred here.
I've followed the instructions so far but I'm stuck.

Facts of my case are;
I have the last 6 years statements from BOS. Sent Freedom of information letter to Halifax, England to get Statements.
I no longer bank with Bank of Scotland.
I've calculated my charges to be £780 over 6 years. (£1015 including 8% interest.)
I understand there is a 5 year rule in Scotland but 6 years in England for claiming back charges.

Where I'm stuck;
Where do I send the demand letter and who do I address it to? (Seeing as I no longer have a local branch)
As far as I can see it would be better for me to go after HBOS in England to get 6 years instead of 5 refunded. Is this correct?
Is it easy for a Scot to chase banks in an English court. Is it worth it for me to set up addresses etc?

Hopefully there is someone out there who has been through this. Cos I aint getting nowhere!

Hi,
My advice is to contack HBOS and ask them for the address of their Data Protection Officer. Once you have that send a Subject Access Request report together with your £10 (happiest tenner you will ever spend) and make sure it is by special delivery as this is your time stamp and they have 40 days.

Now as a scot I am in the same position as you. I am looking to claim 6 years back so you have 2 options.

1. File for the full figure over 6 years and hope they pay up in full before a court date.
2. Depends where the bank is registered. My bank is Lloyds and their HQ is in England so i can either file the court order in my town (Perth) or their home town (somewhere in england, not that far yet). If I pick england then i can definetly ask for 6 years, and they will probably settle out of court saving me the trip south of the border.

You don't need to send off a Subject Access Request as you have your statements.

Having said that you may be able to claim 20 years see http://http://www.consumeractiongrou...ime-limit.html

This might be risky?

See this thread Scottish Small claims court limit... Help about your options.

Just read as much as possible and buy the sticker set from the site to help frighten the bank

Thanks for the responses folks. I've raked the site and the Govan Law centre website. I've decided to just go after the Bank of Scotland in Scotland.
I've weighed up the fact that the difference between claiming in Scotland (go back five years) and Claiming in England(6 years) was only going to gain me £40. Decided that the extra hassle chasing them in England wasn't worth this and would probably cost me at least this to set it up.

I've just received as second batch of statements as well, so working these out just now. Glad I didn't go charging after them straight away.

I'm off to read up on claim splitting now......
