Default Won first summery cause claim

Hi all just to update checked bank account online tonight and halifax have paid my first claim plus costs and interest.Can anybody tell me how long i need to wait before putting in next claim,am doing 3 summery 1 small claims.Thanks for any help i have received from this great site.

I personally would make sure that you have minuted your current claim so that it's dismissed due to settlement and no longer active at Sheriff court. Only takes 2 minutes to do, and leaves you free to submit a new claim; in that case, there are never 2 cases in court at the same time.

Hi there willmur6! I was just wondering if you can help me! I am suing Halifax by Summary Cause on Monday. The only thing I`m worried about is the fact that the woman at the Sheriff Court today told me that a Sherriffs Officer has to serve the claim, and because I`m suing the Halifax, does that mean that the Officer has to go to their head office to serve it?
Maybe I`m better suing my own branch?!?
What did you do?

Hope i can be of some help to you regarding summery cause,what happened with us was,we took claim to sheriff court and filed claim at court at a cost of £39 pounds there, then we went to a sheriff officer to get the claim served they then post the claim to head office by next day signed for mail the cost of this was £15.64 it was sent to halifax on the 20th oct halifax deemed it served on 26th oct paid out on the 23rd nov.Sent our second claim off on monday so we are waiting again.By the way the lady at the court gave us a list of sheriff officers so would be worth you asking for names.Hope this has been of some help to you if i can help anymore just ask.Keep going it will come soon.

Hi Willmurr, thanks for that! I just assumed that the Sherriff Officer had to serve the claim by hand. I didn`t realise that he could post it.
The lady at the court has already told me which Sherriffs Officer to use.
Can I just ask, did you use the standard wording in "Scottish Procedure" for the details of the claim?

Hi All
Haven;t posted for a few weeks,just to update i am still waiting on a settlement for my second summery cause claim which was deemed served on 29/11/06,they have until 11/01/07 for the first hearing.I called customer relations today to ask if they could tell me how my claim was doing and they said a letter was being sent out to me today but wouldnt tell me what was in it hope it is good news.Have been checking bank account all day incase they have put it in but nothing yet.It is good to see so many people getting there money back keep it going.Will post again when i receive my letter and hope all you good people on this site have a GOOD NEW YEAR and all the very best for 2007.

Hey Willmurr6, how you doing? Had any good news lately? HBOS seem to be leaving things to the last minute lately. Maybe they are burried under a huge pile of court papers.LOL Filed papers for my mate she has the same court date as you, she hasn't heard anything yet either.

Good to hear from you again,well i have just checked my online banking and they have paid my second summery claim in, YAHOO off to sales i trot.So tell your friend to keep checking it will be any day now.Well will get started on claim 3 then 1 small claim to go,i was wondering if it would be worth phoning halifax and asking if they are not prepared to pay up without going back to court as they will see by now i am serious,what do you think.Only thing that is bothering me Mairi is i havent been able to donate to the site as i dont have a debit card or credit card at moment,is there any other way of doing it.So to anyone who is waiting keep going as you will get your money.

Ive got to say Im well impressed (and so envious lol) with your success. Im going after LTSB with a summary cause, already been to court once with them and have a second date set for 26 January 2007.

I would say good luck with the remaining claims, but I really dont think you will need it.

Hi again willmurr,
just off the phone to my mate, told her to check her account, money refunded today.. She's well pleased.
I was going to phone them to give them another chance to settle too, but decided not to bother cause they didn't even reply to my offer to settle after winning my first claim. I wasn't in any hurry so i thought to hell with it, let them pay the costs and the extra interest.
Will pm you about the donation thing.
