| | Basic Account Customer | seanski v nationwide Ive recieved a letter from the above after I had sent them my LBA along with the bank charges .They have sent me a reply saying it believes there charges are open & transparent and if I feel that I cant abide by them ...then it maybe appropriate that I consider alternative banking (which I have done anyway) Can you advise on the next step . would also like to kwow if i should claim my money through the Scottish court system .My claim is for over £6k plus interest your advice help much welcomed

| | Basic Account Customer | Re: claiming The Nationwide from Scotland HELP In Scotland due to the small claims limit people are doing one of the following - Submitting a claim through the English courts system
- Severing the claim into amounts below £750 -Scottish small claim
- Submitting a claim via summary cause where the value of the claim is over £750 and up to (and including) £1500.
- Have not heard of anyone using ordinary cause yet which is for claims over £5000
I am currently using option 2 - however I cannot advise you what the best route for your personal circumstances are.Although if you can the preffered option in your case would appear to be -go through the English court -see help on jurisdiction at where can I raise proceedings
It is understood that the England & Wales Money Claim Online service requires a claimant to have an address in England or Wales, and therefore, if you are raising proceedings in England you would have to forward your claim to a particular County Court by post. While raising proceedings in England will entitle you to sue for a maximum of £5,000 under English small claims procedure, if the claim is defended you must be prepared to travel to England to present your defence. Accordingly, you should think very carefully about this issue, weighing up all of the pros and cons.
