Default seanski vs Nationwide

Hi Every1

Ive recently sent my LBA plus detailed spreadsheet outling the charges for the last 4 years ..the total is just over £6k disgusting or what .I would also like to claim back an early settlement fee of over £3500 grand from my previous mortgage company any help welcomed .

Ive recieved a letter from the above after I had sent them my LBA along with the bank charges .They have sent me a reply saying it believes there charges are open & transparent and if I feel that I cant abide by them ...then it maybe appropriate that I consider alternative banking (which I have done anyway) Can you advise on the next step . would also like to kwow if i should claim my money through the Scottish court system .My claim is for over £6k plus interest your advice help much welcomed

Yup, it's just a standard fob off letter. Just ignore it and get on with your claim.

I'm not in Scotland, and I can't advise you of specifics legally, but to keep it simple, I believe you can only claim for £750 in the sherrifs court, so it would be advised that you claim for the oldest portion of the money, and work from there.

It will take time, but you'll get there pretty unscathed.

As Im claiming an English bank for £6k plus intrest at 8% is is possible to claim in potions of £3k each by lodging my claim in a English county court ?

Question claiming The Nationwide from Scotland HELP

I would like to kwow if i should claim my money through the Scottish court system .My claim is for over £6k plus interest your advice OR should I lodge my claim in two lots of £3k via an English county court ? your help much welcomed

In Scotland due to the small claims limit people are doing one of the following
  1. Submitting a claim through the English courts system
  2. Severing the claim into amounts below £750 -Scottish small claim
  3. Submitting a claim via summary cause where the value of the claim is over £750 and up to (and including) £1500.
  4. Have not heard of anyone using ordinary cause yet which is for claims over £5000
I am currently using option 2 - however I cannot advise you what the best route for your personal circumstances are.Although if you can the preffered option in your case would appear to be -go through the English court -see help on jurisdiction at where can I raise proceedings

It is understood that the England & Wales Money Claim Online service requires a claimant to have an address in England or Wales, and therefore, if you are raising proceedings in England you would have to forward your claim to a particular County Court by post. While raising proceedings in England will entitle you to sue for a maximum of £5,000 under English small claims procedure, if the claim is defended you must be prepared to travel to England to present your defence. Accordingly, you should think very carefully about this issue, weighing up all of the pros and cons.

Charlieho has answered your question very well, nothing much I can add to it. Ultimately, it is your decision how you proceed.

If you haven't yet, I strongly recommend you read Scotia's guide to how to claim in Scotland.

thanks to all who replied .Im a novice PC and thread user please excuse me.As youve nearly all answered the ? theres one oustanding issue as folows .My claim is for £6k plus the 8% ,is the best possible way forward to claim £5k plus another claim for the other £1k please advise .Im going to post a claim in England.
