Default Anyone persued in Scotland for Non-compliance Data Protection Act

Have lodged a non-compliance complaint with Information Commissioners Office against Egg on 06 Aug 06 and have had no acknowledgement yet. Telephoned Information Commissioner's Office to find out if they had received my complaint told that they have a large back-log of complaints and they were currently acknowledging complaints received on the 31st Jul.Lady I spoke to was able to search database using postcode and confirmed my complaint had been received.

Has anyone sent a court claim against bank in for non-compliance with Data Protection Act - did you wait for result of Information Commissioners Office investigation?

Hi Charlie, I sent off letter before action yesterday for non-compliance with Data Protection Act request which was sent on the 20th June. this gave 7daysto respond, but alas I really don't know how to enforce such as I believe I should go for a Court Order. Any suggestions?

xiona,

Bit of a loss myself -as from what I've read around this site I can't see anyone in Scotland has tried this via the court yet.I am going against Egg on one account and if it gets to the court summons stage I may try adding it in as part of my claim - Ask the court for unlawful charges on one account but ask for Data Protection Act complaince non on the other- waiting at the moment rec'd first FOB off from egg today -LBA (in which I thing I'll mention Non-complaince on other account) to be sent 21/08/06

Today I issued a summons against BOS for credit card 1, I have a mind to estimate charges for card 2 and file it at the end of 7 day deadline.I think I need to take advice, haven't been well so havent been up to speed. I think it could be wrong to add it to another claim, Sherrifs can be sticklers for sticking to the point.
