Default Cahoot bank charges and interest. Can I reclaim?

Cahoot current account online bank


Account opened in 2004

Due to change in circumstances, my boss started paying me in cash. Cancelled all direct debits with cahoot, started using another current account.

Tried to close cahoot account a total of 3 times in 2005. Was told balance had to be £0 for 30 days. They kept telling me this every 30 days when I called. I opted to give up trying as every time I had to go through a lengthy process of verifying my details.

2008 refused credit due to a bad credit rating… me? Looked into it and I had an outstanding debt with cahoot for £650, that’s £50 over agreed O/D limit. Called them up and because I could not verify my identity, they could only tell me it was a monthly debit for an insurance policy which was now cancelled as it had been returned unpaid.

Unable to pay off O/D at the time, they refused to come to any agreement, O/D now stands at £1k and increasing every month due to charges and interest.

Cahoot have NEVER contacted me regarding this matter or any matter! I only found out through looking at my credit file, which up until now has been almost spotless. It has been a shock to me and I would appreciate advice form anyone.

I fully accept that it has been my responsibility to service this account and keep it in order. Could I reclaim any charges?

Hiya Melon99.

Yes you can reclaim these charges. Have a read of the links in my signature, they will help you with the step by step guide and the How to will help you find your way around the site.

You deed to send an S.A.R - (Subject Access Request) to receive your statements if you don't already have them, so you can see exactly what each charge is for. You will need to enclose a £10 cheque. (This is reclaimable)

SSL your links are for county court claims. Melon99 is in Scotland (although the procedure up until filing at court will be the same the forms and wording of the claim are slightly different). The Scottish procedure is here (please note that the Scottish small claims limit is now £3K, not £750 as in the link).
