I'd like to thank CAG for this forum, the information here is amazing. I've been fighting Debt for a few years now and thanks to this site ( which I only found last week ) I can almost see light at the end of the tunnel.

Current situation :

Virgin money : £3,270 - with only £3000 limit, been trying to get below limit for over 2 years now. ( Virgin lowered my limit to £3000 just as I went over it )

Capital One ( now with debitas ) : larger debt than above.

I'm going to take on Virgin Money first as a sort of testing ground before I take on Capital One, however I have a few questions first ( I hope you don't mind ).


I've prepared my S.A.R - (Subject Access Request) and CCA, I understand the Prelim Letter etc, however I don't quite understand the CCA. Can someone please explain this one for me please, I've also noticed not many people here are requesting a CCA ( I'm a bit confused ).

After reading a lot of posts on these forums I'm uncertain about the MAX value of a claim through the Small Claims in Scotland... Some people say £750 and others say the MAX is £3000 claim ( as of April '08 or something )... any advice please ?

One last thing, what is the current trend with claims at the moment in Scotland, I'm getting the fealing that the Credit Card companies are taking us all the way to court for our claims ( the opposite of what's happening in England ).

Sorry for the questions but I really need to be prepaired for any eventualities ( mind my spelling ,, hahah ).

Any help or advise is greatfuly received.

I'm no expert, so may I ask a of question, when did you take out the cards, as a rule of thumb it would seem the older the debt the less likely an agreement is available, and if it is it would need be in the prescribed format.
An unenforceable agreement means IMHO the company can not collect monies from you, I expect someone will be along with advice, and who understand the system in Scotland.

Thanks for your reply Andy,

I think my Virgin card is approx 6 years old and Cap 1 is around 8 years ( I was dealing with depression around about then, so my dates of opening the accounts isn't very good ).

I think I'll send both the Subject Access Request and CCA to Virgin and see what they can unearth, I'm very interested to see if I did actually agree to a PPI as I don't recall anything about it ( I've never taken out PPI's before with other loans etc, yet Virgin and Cap 1 have been charging for this ).

I'll be sending the documents to them over the next few days, waiting for new cheque book to arrive at the moment, I'll let you know how I get on.

Quick update:

Woohoo got them ! I thought I didn't ask for PPI and I just received my CCA and it clearly shows I didn't tick the box for Payment Protection Cover.

Still waiting for my S.A.R - (Subject Access Request) details to arrive so once that arrives I can totup the total PPI payment + I think I can get overchargement payment refunds also.

Thanks CAG, if it wasn't for you I'd never of checked.

Hi guys, I'm hopeing someone here can confirm wheather my CCA details are legit, as I'm having doubts over it's legality ( I'm far from an expert though ).

I've now uploaded my CCA request details ( the first 3 pages as the others are continuation of current T&Cs ) to photobucket. I'm not too sure if it's total legit. As you can see it's quite hard to read also page 1 refers to sections on page 3 however page 3 is their NEW T&Cs. Any advice here ?

Sorry guys I seem to have got myself into a little pickle here. As you can see above I created another thread under General Section for a specific question, and I seem to be bouncing around the place and posting more in there than here, SORRY if this isn't the correct way of posting...... all this info in CAG, getting info from Virgin and getting help from here has BLOWN my mind... hahaha...
