I sent my Subject Access Request off a couple of months ago and heard nothing back. Due to other stuff going on I kinda just let it lapse. 2 weeks ago I sent them a letter telling them it was 63 days since I had sent my Subject Access Request and I was giving them another 14 days. 14 days up and not a thing. Not even an acknowledgement. Can I write to the Information Comissioner to complain or is Scots law different? Some of the stuff I've read suggests going to court to force them to comply - does that apply in Scotland as well?
I sent a copy of the S A R to their solictors (Greenhaughs) but have been ignored by them too
What is the best thing to do next?

Complain immediately to the Data Commissioner.

Provide them with as much information as you can.

Day 15 - all the stuff arrived. Everything looks ok, at least I know they are receiving the payments.(More about the bits I don't understand later) HOWEVER, they have also sent me an 8 page letter of complaint from another customer complete with name, address,mobile and home phone number HUGE DATA PROTECTION BREACH.
Who do I report this to and how much trouble will they be in?? (The bigger the amount of poo the better)

Hi suzieblooz I had a similar situation and contacted the press (bad publicity for them always makes me smile) The Information Commissioners Office should be notified but I would contact CF first and ask them to explain how this could have happened. I would be very tempted to contact that person also inviting them to complain to the Information Commissioners Office regarding their data.

Thanks Bigmac. Will contact Information Commisioner tomorrow, and am going to write to the other person and let them know so they can complain also. I emailed to Daily Record's financial woman when I got it on Friday but haven't heard anything back yet. Bad publicity is the least they deserve after the stress & upset they have caused me and my family this past year.
BTW, where is your sparkly sporran??

If it's not too late make sure you keep everything you received as evidence - only send copies! Otherwise they'll deny it later!

Oh don't worry, I'm hanging on to everything. Wrote to Info Commissioner. Got reply back from Edinburgh office to say they've passed it on to another dept, so I guess it's wait and see.

HI Suzieblooz, I am having the same problems with Lloyds TSB Scotland plc, their head office is in Edinburgh where I have been sending my letters to, apparently they are forwarding them on to Lloyds TSB Andover in England whom they say deal with all commplaints. Received letter today stating they will not deal with any complaints till after the case hearing. I am just going to send small claims court to Edinburgh and wait and see what happens.

Hi cp1949, what kind of letters have you been sending? Is it your S.A.R - (Subject Access Request) letter, in which case they have to reply within 40 days as the court case has nothing to do with you requesting the info they hold. If it's your LBA(Letter Before Action) then they won't deal with that until after the court case, so the advice on here is to go ahead and file at court. Good Luck and keep us updated.

OK, just read your thread. I see you've done the S.A.R - (Subject Access Request) and LBA. Good luck with the claim. I can't really give you any advice as I went through the FOS and got my charges back on one account just before they froze the claims.
Its so frustrating though, you've been at it for ages then they put everything on hold. However, at least if you've filed at court you will be at the top of the list if they find in our favour, and you can get interest back as well.
