Default Charges from Cap1

Hi everyone

I am due £690 in charges from Cap1, which FOS helped me reclaim. However, Cap1 will not remove the default notice for £690 and FOS will not get involved. This means that I will need to take them to court. When taking BOS to court last year for my charges I had to go to a Sheriff Officer who served the notice on my local branch. My question is, how will this work when there are no Cap 1 branches in Edinburgh, where I live?

I would be grateful for any help on this.

I would write to the Information Commissioners Office about this first. Explain how the charges were returned and that the default was caused by these charges. The Information Commissioners Office should be able to sort that out for you.

I might sound a bit thick here, but I wouldn't have thought the Information Commissioners Office would be able to help with a matter like this. I thought they were there regarding data protection issues.:confuse d:

They deal with consumer complaints regarding data that is about you and which you feel is unfair so should help you with this.
Regarding the summons you could opt for the postal service via the sheriff officers, and its cheaper.

The sheriff's Officer will issue the Summons to Cap 1's Head Office, they did when I won my claim against them.
