Default ymcmurtrie Vs Clydesdale Bank

Hi everyone,
I'm new to writing in forums and finding it difficult to navigate my way through all the postings looking for areas to help me with my specific bank.

I have previously made a posting, however the moderator directed me to the Scotland group (which I cant find) or the Yorkshire group (which I also cant find) So have decided to start a new posting in the hope someone can help.

So far I have read the FAQ's and printed my first Data protection act letter requesting history from my accounts, one credit card, and two current accounts, all from Clydedale bank. I live in Scotland, and understand there are changes to the law in Scotland, but I cant find anything specific.
I have made an appointment with a different bank (Royal Bank of Scotland) to open a basic account incase Clydesdale don't comply and shut my account. I will be sending off the Data Protection Act letter as soon as I have confirmation that my new account is ready to use, then follow the steps as I have read them on the welcome page until the case is closed and all monies recieved.

First though, I have a few questions. One being, upon calculating the charges owed, I read that £12 is acceptable, so should I count each charge less £12 and claim that back, or do I write claiming the full £22.50p? I have read some people are offered some money as a goodwill gesture, and understand I can take this, as long as I sign nothing, and state I will be continuing my claim for the remaining sum. I just cant find a answer to how much I claim for.

My next question is, if the bank decide they want to phone me to discuss the claim, Am I within my rights to tell them i'd prefer all correspendence to be in writing? Each letter I send will be by recorded delivery, and I will keep copies of all letters, and recorded delivery slips, both for my own records if it goes to court, and to help others if they want to hear my experiences on completion. However, if anyone has taken on Clydesdale already, and can tell me their experiences and dodging tactics etc, I'd greatly appreciate it, because knowledge is power....

Thanks in advance, Good luck to anyone in the process at the moment, and I'll keep you all upto date with each step

Yvonne

P.S. at the bottom of this page it says "post a poll" can anyone tell me what this does???

Thank you! I've just this minute found it, But wondered if you could answer a quick question if you are in the same position as me...? I have a couple of bank statements from 2005, and noticed they have changed me £25.00p for a returned direct debit, but later in the month they charge a £22.50p "service charge" this only happens in the months that have returned fee's, so my question is, do I reclaim for both, or just the £25.00p returned direct debit fees? I know I cant reclaim service charges for over drafts etc, but these are usually £6ish, and on top of the £22.50p

If anyone can help - i'd greatly appreciate it!

Personally I've claimed for both - they only charge that 'Service Charge' after you've been overdrawn during the previous month, therefore (in my humble view) it can be claimed back along with the rest.

I'll move the details of this to the Scotland for you, to keep things organised.

You'll find that help is a lot more forthcoming this way too.

I'm in the same boat as you, as is one of the other Moderators so you're in good company!
