HI I am new to the Scottish Forum, was in the general forum and was advised to join this one. I have sent my premilinary letter asking for a request of payment of fees as I already had my bank statements. I received a letter back within the allotted time and told that they were not dealing with any claims till the court hearing has been heard. I was advised to continue as normal and I have sent a letter before action. Will let you know what the outcome is.

HI Bigmac

I sent letter one as I had all my bank statements, they wrote to me and told me that all cases were being held back awaiting outcome of the test case. I then sent them a letter before action with another statement attached. As yet I have had no reply.

My claim is for less than £500 but since I first wrote to Lloyds I have had another 140.00 taken from my account for returned direct debits. Should I just leave the 140.00 .

No add this by sending the bank another schedule of charges which superceedes any previous schedule sent. You can alter this amount up to filing at court which by the way is your next step.
Small claim will cover it.
