Default Dan Phillips vs RBS

Hello all,

Right first of all... I have read through the website and understood the following procedure about claiming my unfair bank charges. I sent my first letter (Preliminary letter) on the 5th February to my bank (RBS) explaining what I was going to do and that this was deemed wrong by the OFT (blah blah.. and so on). I gave them 14 days and had no reply.

I then sent my second letter on the 21st February (Letter Before Action) again explaining in the letter that I would continue this to court. Still haven't heard from them.

However, after reading more cases from other people taking RBS to court I feel I have sent my letter to the wrong address. A lot of people seem to have gone through their local branch when I just sent it straight to their Head Office. So this has left me in a predicament.... Do i send a letter to my local branch with a copy of each of my letters I sent asking for an explanation as to why I have heard nothing or do i still continue with my time scale and file a Court claim after these last 14 days have passed sending it to the Head Office address again??

A bit of light on this would be gratefully appreciated. Cheers

If you send letters to your branch, it gets passed on elsewhere anyway. I would imagine even if EH2 2YB is incorrect it would have been passed to the correct address.

Just proceed as the guide says.

It is worrying when you don't hear from them but bear in mind the number of complaints that banks are received are possibly doubling or tripling by the week and they simply cannot keep on top of them all. They will certainly start responding once they are receive your court claim! Added advantage is getting a larger claim due to the 8% statuatory interest you get to include!

Hey T14 and welcome!

Your deadline for the LBA is 7 March so wait until then.... if you don't hear anything file the claim.

It doesn't matter whether you send it to head office or your branch as they will forward it to the correct department. I sent all my correspondence to:

If you have read the RBOS Contacts and the address you gave was in there, then that should be fine.

I sent mine to the branch, never heard anything after prelim letter but had a phone call earlier today now they recieved my LBA. I sent both recorded delivery so I can prove they have been recieved.
The girl that phoned said it had been passed to the relevant department but i should have had an offer of what I was looking for sent out. If I don't recieve the offer by Tuesday I'm to phone a girl at my local branch, although not sure what she'll be able to do for me. However deadline still ticking for filing my claim through court
