Unhappy Charges From Benefits?

Approximately 8 months ago I went slightly overdrawn on my account overdraft of £200: £3.12 = £203.12… for this the RBS charged me £28.00!

Due to the nature of my finances at present, ‘Incapacity Benefit’ paid directly to my bank account: there is never enough money going into the account to bring me out of my overdraft: so each and every month now… charges are added which take me back over my overdraft limit, to then which charges are added again the following month… so on and so forth!!

Are these charges Legal… and what are the rules/laws with regards to taking charges from State Benefits? Thank you.

They are allowed to, although I think it is wrong that they can.

There is something you can do on a one off basis which is called Appropriation - have a search on here (try spelling it differently if I got it wrong

Hope that helps - are you claiming the £28 back now ?

Ty for your reply.... As they keep taking out the charges... they keep making me go over my limit...which means they charge me again the following month!!When I have worked it out, I will be claiming 'All' back

Eg, the best thing you can do to begin with is open a new bank account and have your income paid in there instead then let the old account rot whilst you start the process of claiming back your charges.

If you can't set up another bank account, you can have your benefits paid to the post office.

No point in you losing out on your benefits for unlawful charges now is there?

It would also be in your interest to make an offer of repayment on the overdraft you have there, and to confirm that the account is in dispute, that way they cannot (or should not) foreclose on the overdraft/default you/involve a debt collector agency to recover.
