 I was in court today
I was in court today for alleged non-payment of rent. They have a ccj (decree in Scotland) against me for this, here's a brief rundown of what happened.
round 2 to me, their lawyer had no info, I had it all lol. Their lawyer said, I have no information regarding this, I replied to the sheriff, would you like me to give copies of all correspondence the the claimants solicitor? Sheriff said, why should you do their work for them Mr xxxx, I replied, I am only trying to be helpful m'lady. So it's continued for 4 weeks to allow them to get their act together. clerk of court said, the minute for recall has not been served on the claimant, I said, yes it has and produced one email and one recorded delivery letter, however I only sent these to make sure they had it as it is the duty of the clerk of the court to serve on the claimant and not the defendant's job to do this. Sheriff agreed and said well you have certainly been doing your homework have you had any legal training? I replied only from the university of google m'lady. She had a good chuckle and said to their lawyer, it is very unusual for a defendant to come better prepared than a claimant's solicitor and gave the other sides lawyer a stern look lol. Well I could stand there with head held high, after it their lawyer came and spoke to me. I said look you dont know this but I was illegally evicted and will give you a peak at summat. Showed her my spreadie of how much I am going to be counterclaiming, she said omg thats terrible. I said exactly!
Moral of this is that if you do your research and prepare properly you should be fine.
