Default unfair deposit deductions

my daughter has just left rented accomodation (9/04/07) and the landlord did his final inspection with my daughter and my wife and said all was fine, then three weeks later when we asked for the deposit back he said there was work to be done ie. decorating and carpet cleaning (even though we had them cleaned prior to her leaving and repainted any marks she had caused)etc so she would have to wait to see what was left of the deposit. When she started the tenancy there was no invetory done and she carried out small repaires from the last tenant now the land lord will not answer any calls/texts about the situation we are at a loss what to do next

First of all no inventory no deductions is a simple rule.

The Landlord also agreed that the property was OK on the meeting.

Write to your landlord and state that if you do not receive your deposit within 7 days you will have no other option to take further action.

rovers; such situations are frequently discussed on this forum therefore you need to do some reading here.
Shortly; no inventory= the landlord has no leg to stand on with regards to witholding of the deposit. This is because he has no evidence to compare "before" and "after". Next; read http://www.consumeractiongroup.co.uk...tml#post643195
Write to the landlord demanding full return; he spent YOUR money without your permission, knowledge and against his initial advice. Give him 14 days. Bang on the 14th day, write Letter Before Action where you reitarate your point, give hi further 14 days as a last chance to reconsider. Finally, ask the court to issue summons.

I like to think so, you are giving the ignorant landlord 14 days though, I suppose I was being a little premature with 7 days, lol.

It makes me mad though how landlords think they can hold deposits for so long.

We've just got rid of one of our landlords because he was a pain in the arse returning deposits when tenants had left the property in excellent condition.
