Guarantour problems

Hi all, I was wondering if any of you could help/advise me at all..... I signed to be a guarantour for my wifes friend around 2-3 years ago... now just recently my wifes friend has had some serious financial difficulties and as a result has been unable to pay her rent for the past 3 months... she has now moved out into another property ( cheaper ) and still has to repay the previous landlord back... however the landlord has ( Understandably ) had enough and is going to persue this via court, now technically this has become my debt as I was the guarantour, however I have since learnt that the contract I signed expired some time last year... My question to you is basically if the contract has expired then am I still liable as I could end up with a CCJ over this?

I think it would depend on whether your friend started getting into arrears before the expiry date of your guarantorship?

also if the contract was for say 12 months and then become a rolling contract you will be still liable - if the 'friend' siged a new contract then no you more than likely aren't.

A guarantor agreement usually lasts for the duration of the original tenancy plus any renewals or extensions to it, so on the face of it, yes you are still liable. You should check the wording of the agreement you signed, and take advice from CAB or a solicitor if you are unsure.

Cheers all, i will try and get a copy of the contract.... where would I actually get that though?, the LAndlord or the agents, plus how can I request this as im just a guarantor.

You should have retained a copy of the guarantor agreement that you signed. If you don't have it, you will be able to get a copy from the agent.
