that defines your rights with regards to deposits.
If there was no checking-in and checking-out inventory, the landlordy would be unable to prove in what state the property was in upon your arrival and exit.
Write to him, requesting all your money back within 14 days.

| | Platinum Account Customer | Re: Landlord won't return my deposit you (like so many others) have fell into the trap of not doing a walk round inventory with the landlord, and presumably not taking photographic or video evidence of the place prior to you moving in.
if he is keeping your deposit because of repairs etc that he has to do, then he can only keep the amount needed, not all of the deposit, (unless it takes that amount of cash to do repairs).
to do this he should (as far as i know) provide you with copies of the quotes for the repairs so you know how much of your deposit he will be keeping. at the moment its a little bit of six of one and half a dozen of the other, because you cant prove what condition the place was originally in, but then again neither can he.

| He needs to properly justify withheld amount. He is keeping your money and the judge will expect him to provide details and evidence how it was spent.
So if he intends to counterclaim, he better has a very good reason- estimates, invoices, evidence that you gave your permission to go ahead with these expenses:o , unpaid liabilities, outstanding rent etc, signed inventories (checking in and exit).
Go ahead with your claim and remember that you also need to very clear on why the deposit should be returned. If you like, post your particulars of claim here and we can comment on it.

I used to do maintenance work for a flat letting agency who had two lock ups just to tag and store such items.
Not sure of exact legalities, but it is that you are paying for the old damaged (as he would say) flooring, but on an 'old for new' basis. in simple terms you are buying the old flooring from him at the price he paid for the new ones.
As joa said he will have to provide details fo how money was spent, so ask him for a breakdown now. If the flooring is on it ask him what was wrong with the old flooring and ask to inspect it (so you know if he has kept it)
you could ask a friend to view it if it is back on the market , then they could take some photos to show if the work has been done or not, as it is supprising how many landlords in the past have asked me to give them false invoices for work that was never done, or put a different address on an invoice. ask for copies of the invoices, you can then call the number on the invoice and ask questions like when was the work done and what colour were the walls before you painted them and record the call so you have as much evidence as poss if you need it in court
