Tenant notice on AST Hello, we signed a new Assured Shorthold tenancy on Feb 1st 07, for 12 months; with, I believe, the usual 6 month break clause (with 2 months notice.)
Could someone please advise whether we can give notice on June 1st that we intend to move out on August 1st? Or do we legally have to wait 6 months, and then give 2 months notice?
I ask as I've been informed that the landlord can give us notice at any point within the 6 months that he intends to break the contract at 6 months (as long as we get at least 2 months notice...and I wondered if it worked both ways.
Here is what the agreement actually says: Surrender of the tenancy by the tenant.
5.5 Either party may terminate this agreement by serving not less than TWO calender months written notice, such notice may be served at any time but will not expire before the completion of the minimum term of SIX months has been completed from the date of commencement of the term thereof. On the expiry of such notice this agreement shall determine thereon but without any prejudice to any antecedent breach of the terms hereof by either party.
