Advide needed !

I would really appreciate some advice on a tricky situation.

My Mum and Dad divorced approximately 10 years ago, at the time he was 'bought out of their property', he then remarried.

10 years later his marriage collapsed and he has been left with very little money, not nearly enough to buy his own property.

My Mum has taken pity on him and although he is not yet divorced from his present wife she has allowed him to reside at her house.

He has been their for over 6 months now and Mum is very much regretting allowing him back.

He does contribute towards some of the minor bills and has moved his furniture into the house.

Can someone advise me where my mum stands if she wants him to leave the property - does he have any rights to stay or even any claims to the house.

if it was that his interest in the property ten years ago came to a legal end...sorry do not know what you mean by "bought out", presuming you mean that your mother paid for your dads interest in the property and the title deeds are now all in your mothers name.

notwithstanding the point that she may not have the sole legal interest in the property, and is something that can be answered with more information, but if she does own outright all the property then your father is a bare licensee and as such has the bare rights purported onto him, from what you have said there does not seem to be an express contract between them, more than that of a family member that pays "board and lodgings", so if your mother is asking your father to leave then she can do, would advise with reasonable notice, to show that she is being reasonable and not tryign to dump him on the streets, but as i say it does depend on what "claims to the house" you think your father has.
