Angry Landlord Is Not Doing Any Repairs

Hi Again,

I Have Phoned My Agents On Two Occasions Regarding The Rotting Wood Work In Our Lean To, It Has Lots Of Woodlice Coming Out Of It And They Will Not Do Anything About It, Is There Anything I Can Do ?
They Just Keep Making Excuses All The Time, Surely They Are Breaking There Side Of The Contract.

send recorded letter to letting agents outlining demands, but check your agreement to see who deals with repairs
ie general upkeep/maintenance

I Will Do That , As For The Repairs It Is Down To The Landlady, The Agents Have To Ring Her Up When Things Need Doing.

How Should I Write The Letter , Do I Give Them A Timescale?

As Said In My Tenancy Aggreement It Is Down To The Landlady To Do The Repairs On The Windows, The Whole Frame Has Completely Rotted On The Outside Aswell As The Inside.

Tell her that she is in breach of S11 Landlord and Tenant Act 1985 which puts the onus on the Landlord to mantain the property.If she refuses then I suggest you get on to Enviromental Health at your Local Authority.

There is a specific protocol to follow in disrepair cases. You cant afford any mistakes in that process. Before you send any letter I would recomend that you seek some advice. There is an organisation which provides free advice called Shelter.

Additionally, it may be an issue which affects the structure...also, be prepared....complaining or taking legal action can result in your tenancy being ended...not renewed etc....

There is a protocol for disrepair cases and it has to comply with CPR 35.i wasn't suggesting that she took legal action but use EH to inspect and they will issue an enforcement notice if applicable.As there are rotting windows frames the landlord would be in breach of S11 and under the HHSRS they would be a catogory 1 hazard.Only EH would be able to enforce this and may take legal action if it is warrented.By the way S.J I work in Housing Litiagation as an EHO and expert witness and would not advise legal action on this or the other forum I post on giving Housing Advice unless there is a good enough reason.
