Default Periodic Tenancy Notice Help

Hi

We came out of a fixed term tenance on the 16th June 2008, this changed to a periodical teanancy as we are looking for a bigger property.

The original fixed term tenancy had a stipulation that we give two months notice. The property agents have sent us a letter in May stating that we have switched to a periodical tenancy. This also states that we have to give two months notice. We pay rent monthly so surely we have to only give one months notice?

I have rang them this morning to clarify and they still state we have to give two months notice, are they correct?

We may have found another property and will be ooking to move out on the 14th September (rent is due 15th September) so if we give notice this week we are giving more than a months notice but not two.

What can I do if they do not agree to our notice period?

No, they are wrong. See section 5 (3) (e) of the Housing Act 1988 which provides that when a tenancy goes periodic any notice provisions contained in the fixed term agreement do not apply.
