Council Tax in HMO??

could anyone let me know how council tax should be shared in house in multiple occupation?? In our shared house is 6 rooms and just two are occupied, how should it be done? Our landlord is divide whole month payment just by those two rooms. Is is right?? Shouldn't divide it be number of rooms in house and after we should pay just our part?

in my agreement says:
'In the event that any tenant ceases to be a full time student at any time during the period of the tenancy, then each such tenant will pay the council tax witch will be consequently payable to York City Council'

is it a passing on liability?

please help!! my landlord is taking my to court.

As far as I understand it, a property occupied solely by students will have 100% discount on Council Tax. If one of the occupants ceases to be a student, but the others all remain students, the discount will reduce to 25%, all occupants named on the Council Tax bill will be jointly and severally liable for this amount. If more than 2 people become non-students, there is no discount, and everyone named on the Council Tax bill is legally responsible for making sure it's paid.

This property was a student sherehouse but now it change and no students anymore. By the law in house in multiple occupation the landlord is responsible for council tax, but the thing is how it should be dividet by tenants?? by rooms or by persons, becouse now just 2 rooms are occupied and rest is free. Should we pay for whole house or just for the room with we paying rent for??

In short: By tenants

Unless each room has its own address, the council tax bill is raised per address not on how many rooms is let or how many is vacant.
