Default Credit checks - who does the decision lie with?

Hi there....I am just about to go into my first letting contract through an estate agents....my partner and I have been renting through a private landlord for 18 months and didnt realise how much paperword and cost it would be!

We have decided on a house and have been given forms to fill in. We have been told we need to pay £160 to be credit checked as a married couple (although we aren't married). My problem is we both have really bad credit! We were foolish when we were younger and both have a CCJ and a default. We have a guarantor, and we can get fantastic employment and landlord references, and the agency are saying that we shouldnt have any problems even if we fail the credit check as we have a guarantor.

My question is, are there circumtstances where after we fail the credit check (which i know we will ) the agency will just say no straight away without considering our guarantor?

We went to view the house and got on well with the landlady, and agreed a 2 year tenancy with her, and my question is, are the results of the credit check given to her for her to decide whether to let to us, or do the agency make that decision without consulting her?

Find out what referencing company the agent uses. If it is Homelet, they are AFAIK the most unforgiving regarding CCJ's.

They will give no more credence to a satisfied (paid) judgement than one that remains unpaid.

One absolute must is to tick yes to the bad credit box. If you tick no, then this is regarded as lying (even if you genuinely didn't know about a CCJ - and it does happen if you move property and letters aren't forwarded)

Hi, yes it is with Homelet....I spoke to the guy at the estate agency today and he said as long as I tick yes to the CCJ box, and have a guarantor in place I wont have a problem...He said that only people who have £50-100k CCJ's (i.e mortgage) will be rejected out of hand, and he is sure that it will just go through as 'okay with guarantor'

Im off to pay the fee tomorrow so we'll wait and see.............
