Hi Phat256

If you do not pay your rent you still owe your landlord the money. The money you owe is known as rent arrears. If you don’t pay the rent your landlord will have the right to evict you. The Landlady here, has to provide a detailed account of the payments made by you, and the payments that were missed.

Your landlady may agree to you paying the arrears back over a period of time rather than in one lump sum. Try to agree an amount that you can afford, with your landlady. Debts such as rent arrears, where you risk losing your home, are much more important than debts such as catalogue payments.

It would be a good idea to do everything in writing from now on. Explain to the Landlady that threatening texts will be dealt with by the Police if it continues. Making anonymous or abusive phone calls is also a criminal offence under section 43 of the Telecommunications Act 1984.

It would be worth looking at this Legislation. It maybe that you are paying too much rent. How much are you paying per month?

The Rent Act 1977 sets out the rules for setting Fair Rents and the Rents Act (Maximum Fair Rent) Order 1999 limited the amount of rent that can be charged.

With regards to the Mould and Wiring issues, your local authority has legal powers to ensure your landlord/letting agent tackle any problems with the condition of your home. Council officers will, where necessary, take statutory action to ensure that landlords meet acceptable standards. Give them a call to see if they are willing to look for you and give some advice.

Also i would open another bank account like the NatWest Step account, and have your money paid in there. You can then start to reclaim those charges they have been charging you.

I would have thought that you still owe your arrears to your previous LL. Can someone iron this out? Unless she bought the property with the arrears.

Keep all the texts and start putting things in writing. If you want it checked, write a letter on here and someone will look at typos and wording for you.

To try and understand what's going on I might be useful to find out a few things.

1. Do you have a tenancy agreement? Can you give details of it and when you moved in? Did you renew the agreements at any time or sign anything new?

2. Do you have a contract? It should give details of the landlords contact details.

3. Why did the landlord change? And why is the old landlord getting involved?

You can tape the conversation but I don't know if you could use it as any sort of evidence.

It is important to know how you 'know' you have a new landlord. Did they write to you about it? Have they ever written to you? Was the house sold or something? This all seems so murky so it might help to start thinking in terms of what you know to be true.

It may be that you still have your old landlord. The landlord is the owner of the property. Maybe the new lady is just there to collect rent. She may be acting like an agent. It could even be the case that the landlord brought this lady in to enable her to play 'good cop' 'bad cop'. However, as yet, we just don't know until we get some information.

How do you pay rent? Do you have receipts or proof of payments?

I would suggest that you compose a letter which you can send, recorded delivery, to the solicitors address on the contract. It should ask for a valid name and address for the landlord. If the solicitors are involved they should have to supply this. Send it recorded delivery. No need to mention it to the landlord yet.

With regard to their behaviour toward you; try and keep a record of everything. Tape record the meeting if you want but I'm not sure about rules and evidence for this. You may need all the texts for proof of their treatment of you.

Someone with more specialist advice should be along soon but hopefully we can get somewhere first.

I'm not 100% sure, but I believe you can submit a transcript of phone calls and conversations if they haven't been warned beforehand that you are taping it.

If she or her agent should utter one single thing racist, then you have her.

Will dig into the taping thing a bit more when I come back and see what I can dig up.

The contract should say. It should be around 8 or 9 % per year. It might not say that though. I am really not sure in this point.

Am I right in understanding that a letter has been sent to the solicitors to ask for the address of the landlord? Who wrote it? What did it say? Did you keep a copy? Was it sent recorded delivery?

I think that, if you are not provided with an address, 1 of 2 things will happen.

1. If the solicitor is withholding it, they will be guilty of a criminal offence.

2. If they don't know it, you will not owe rent until you are given the address.

Keep the texts on the phone also. This will make the evidence stronger.

Harasment is a criminal offence. Put this in writing to the police. They always lie about that. They are useless. Write a letter to them about the harassment and requet a reply in writing or they will do nothing.
