AST Contract

Hello all.

I moved into this property last March 2007 for a term of 6 months on a Assured Shorthold Tenancy. I signed the contract in the March and after the 6 months my Landlord was happy for me to continue living here.

I`m having no problems with the Landlord as they are fantastic and resolve matters quickly but a year has passed now since I last signed a contract. The Landlord did say to me over the phone that they will sort out a new contract but have not. I don`t like to pester them.

I was just wondering where I stood? Could I be evicted at any time? Do I have any rights?

1.As soon as the fixed term tenancy expires,you have what is called a period assured shorthold tenancy.
2.As long as you pay the rent on time and the landlord accepts it you could in theory carry on forever like this.However,this does not normally happen as the landlord would want to increase the rent further down the line.
3.When you have a periodic tenancy you can give one month notice to vacate and the landlord must give you 2 months notice if he wants you to move out.
4.If you had not moved out by the end of the second month the landlord must go to court to evict you.However,as your tenancy has always been
a shorthold the judge must grant the possession order.

So,as you see you have rights and in my view there is no need to ask for a renewed tenancy.

Hi Nightmare4banks and thanks for the piece of mind.

As I said my Landlord is as good as they come and likewise I am a good tenant causing no trouble and paying rent on time everytime.

It has just been on my mind recently worrying about not having a renewed contract and as I have never heard of a Period AST I didn`t know where I stood.
