Default tenancy agreement

hi, i'm new here and wondering if anyone can help. i work for a disabled person who has a private let in scotland. when he took the let it was agreed that the rent was ~£300 per month. now 3 years on they are pursiung him for a massive amount of arrears cos they say that it was £300 per week. can we challenge this? no one seems to have original tenancy agreement including tenant or agreement that states that this was agreed rent. help!

Who was the agreement with ? was it the owner or an agent ?

Who is trying to claim back the arrears ?

I would suggest that they will have a copy of the original agreement, however they will not be likely to produce it to you, as if what your saying is true, it will show the expected rent to be £300 per week, which is possibly the mistake they have realised they have made. Without the agreement (signed by landlord/agent and tenant) they will not have a claim at all

It took them three years to realise that they were £900 per month short?

Seems a bit odd to me. Please post some more details, excluding private data of course.

I was involved recently in a similar situation (albeit with a much smaller discrepancy between what I was paying and what the l/l thought I should be paying). I was advised (by my local authority private tenancy team) that, due to the length of time the landlord had been accepting what I had paying without querying it, he had acquiesced that this was the correct rent.
