Landlord vs Letting Agent Wonder if anyone can help
I recently terminated my agreement with the letting agent since it's been 2 months since the property has been left empty. He told me that the last tenant left without paying the last month's rent and so I collected a set of keys.
I went to the property and found some of the fixtures were missing, a door removed and placed in the wardrobe, etc, etc. I had also paid him in cash prior to the last tenancy for installations of radiators and bathroom fixtures to the tune of £700. (Unfortunately, I had not gone to inspect these before he put in the tenant). On getting to the property, I found that these were not carried out.
I had a contract with the agent and not the tenant, so I have no forwarding details of said tenant.
I now have had final notice from the council tax office for non-payment. I have no details of tenant to pass on to them. The letting agent has refused to respond to my emails and phone calls requesting the tenancy agreement, electricity certificate, keys, and refund of payment for work not done.
Can I ask for payment for the missing and damaged fixtures since he kept the deposit (though he said the tenant asked for this to be used for his last month in the property). He claims that when he went to the property to collect the last rent, the tenant had absconded.
What do I do now? Is there a sample letter I can use to make a court claim?
