Left after 12 months, but no notice given...

Hello, I'm trying to find out if I have a leg to stand on with regards to getting a deposit back. I'd be grateful of any advise if you would be so kind.

We vacated our property after 12 months (when our contract was up, after paying 12 months rent), handing in our keys which the estate agents were happy to accept. We didn't give notice in writing however as we made it very clear at the start of the tenancy that it was for 12 months only.

The estate agents now claim they need it in writing a month prior to leaving. (I haven't got the tenancy agreement to hand but I'd imagine it would say that.) As such, they are holding our deposit.

Given that it was a twelve month contract, not thirteen month of however many, and we didn't agree to continue after the twelve months, do I have any rights in getting the deposit back?

Assuming you moved out on or before the date that the tenancy ended and handed the keys in on or before the date the tenancy ended then they are telling porkies. There is no requirement for one months notice. The tenancy was for 12 months, it ended after 12 months at which point you moved out. End of story you dont owe another months rent.

Out of interest, did the agents/Landlord issue you with a section 21 notice at the start of the tenancy?
