Hi

I understand that the issuing local authority has to respond to an appeal for a vehicle being clamped and removed within 56 days. This time has now past and I sent the letter registered post and a accompanying email to Lambert council. What would be my next steps to reclaim my costs?

Have you checked on the Royal Mail website to see if the letter was received and what date with the recent strikes a lot of mail was delayed?

Thanks For The Reply. Checked The Royal Mail Website And The Letter Was Received 02/02/07 And Signed For.

Not Sure What To Do Next! The Npas Website States If The Local Authority Does Not Reply Within 56 Days They Must Refund All Charges To You.

Would A Letter To Lambeth Council Be My Next Course Of Action?

By not replying within 56 days, then the Council are deemed to have accepted your representations.

You need to write to them again (recorded); point out that you have received no response from your appeal of 02/02/07 and therefore it is deemed accepted and that you wish you charges refunded. Point out that unless these are paid within 14 days, you will pursue via the Courts.

If the council does not reply within 56 days of receiving your representations, they must cancel the Penalty Charge Notice and refund all the charges you have paid.
