Tenancy Deposit Scheme

Can someone give me some help on the new Deposit Scheme?

I have been living at my house for a year and a half, with a new contract signed every Six Months.

From what I can gather from Shelters website, even though we paid the Deposit last year, and therefore before the Deposit Scheme came into effect on April 6th, this would not cover our Landlord… except that we signed a new contract to continue for another 6 months on the 4th of May 2007, according to the information, this means that despite the Deposit actually being paid to him over a year ago, he would now have to register our deposit with the scheme as we signed a new agreement after the new rules came into effect.

Have I understood him right?

Not sure but I understood it as you only register the deposit when it's paid now, so as you dont pay each 6 months there's nothing to register, I think

From what I can establish we are NOT in a periodic tenancy.

Due to some difficulties at the beginning of our first 6 months living there, he decided that every 6 months he would sign a new 6 month contract with us, so (he said) if there were any future problems he could get rid of us easier.

So on the 4th of May 2007 we signed a new 6 months fixed period contract, an Assured Shorthold Tenancy for a Furnished home as the other 2 were (its actually unfurnished)

From what I can gather, this means that he should have moved our deposit over to the deposit scheme, im just trying to get some more confirmation from our resident experts, please

Also, if it helps, he raised the rent (a week before the next payment was due, this new rent is reflected in the new contract, while previous contracts would have the old rent amount)

He needs to protect your deposit in the scheme for every new contact after April 2007.

The only exception is an exhisting contract which roles on periodically and was signed prior to April. From what your describing it is a new contact and needs to be secured.

Im not an expert but have done a fair bit of research recently when the kids rented some flats
