I am no longer at that property and
my name is NOT on the original
tenancy agreement.
Can they pursue me for arrears ? |

Unless you have made arrangements with the council for your name to be removed, it is my understanding that you are jointly and severalby liable as you are with any other debt, up unti lthe date your name is removed from the tenancy. |

The fact that your name has changed means nothing, you're still the person that signed the agreement. As long as you have stuck to the terms of this agreement in terms of giving notice etc., then you should have been taken off the tenancy and a new single occupancy tenancy created in the other tenant's name. If you did not stick to the terms of the agreement, and therefore are still on the tenancy, then yes, you would be jointly/severally liable for the arrears.
You also haven't answered Mr Shed's question of whether it was a fixed term tenancy, i.e. six months/twelve months, or a periodic, or rolling tenancy, which usually happens after the fixed term is up but the tenancy still continues. You need to give more detail if you expect the correct advice. I will reiterate that just because you have changed your name, it does not mean you have 'got out of' the contract.

I'm not usually one to judge, but trying to get out of a contract on the basis of your name has changed is somewhat shameful. And, to clarify the legal point, no that would not make a blind bit of difference. However, if you have given correct and valid notice then it does, hence my questions. |

Whoa there, the council caused the mix up
in the FIRST place when they offered me the tenancy.
This was back in 1987 by the way.
I had seperated from my NOW ex husband at that
point.
It was them who provided HIM with a spare set
of keys,thereby allowing HIM access to the property.
And it was THEM who said it was a JOINT TENANCY. |
