Exclamation Unfair Deductions Please Help

On moving out of a property the landlord did thier checks and we signed the agreement That NO money from the deposit was to be deducted.

2 days later a man from the office Phoned to Inform us that we would be charged for Two replacement carpets.

I have already phoned citizens advice who said that this was breaking the law and the landlord didnt have a leg to stand on.

I Phoned the companny today but was fobbed off and told i would be contacted Tomorrow.

I am now unsure of what to do about this.
Was thinking about a "Letter Before Action" if this is not sorted out over the phone tomorrow as this is clearly unfair.

Am i entitled to a copy of the document that was signed under data protection?
Could i please be pointed in the right direction of a LBA?

Any help would be appreciated.
Thanks

You should really go through the correct procedure, i.e preliminary request for payment of deposit then 14 days later LBA (in templates library) and yes you should have bee given a copy of the outgoing inventory or agreement anyway, so ring and ask for it
Good luck

This link is in the sticky's but it is a very good letter template. Plus read through the Arla link. They can only charge you for replacing like for like, not brand new carpets!http://www.consumeractiongroup.co.uk...ns.htmlregards, Joan

Unfortunately, if you are considering legal action, you have to forget about the fact that they stated no deductions would be made. You should have RECEIVED that in writing(not just signed something for them). Without it in writing, you cannot enforce it.

So, with that in mind, back to basics. Upon entering the property, did you complete, sign, and return a fully detailed inventory to the landlord? What reasons have they given for the carpet replacements? How much is your deposit, and how much are they wanting to hold back?

Deposit is about £1800. We did sign an inventory. carpets are about 4 years old as the flat was fairly new but we did no damage to them (no spills etc) They did not give any reason or price for the carpets in question.
I am concerned because we were there when they inspected the property as we were leaving and they agreed there was no damage whatso ever and we would recieve the full amount back. then signed the sheet etc.
Gonna phone today to see if i can get a copy of this. surely i am entitled to a copy?

But you cannot prove that this copy ever existed, which is the problem. You will request it(which you probably arent entitled to per se), and they will probably turn round and say "what sheet?". Or, they could doctor it so it removes the bit saying no deductions to be made. Did the sheet itself have words to this effect on it? Your initial post hints it did, but your second hints that they may have verbally mentioned it.
Also, how much are they trying to keep?
