Default Please Help! Eviction Notice?

Hi, landlord just told me the court has given an eviction date on the 20th to leave the property, i have no where else to go, will the council help me with a place or do they not have to because its not gone to bailiffs yet??? do i have to be physically removed by baliffs before they will help???

Please help, very confused??

Once you recieve a copy of the court order you should take it to the council and they should then treat you as homeless.

Hi Guys, need your help again, went to housing centre with the copy of the court order, they told me, well why do you need a place now, come back near to the eviction date???

essie, this is the case with local authorities all over the country, especially in homelessness cases; they will act as a brick wall, they will do as little as lawfully possible. Call/visit/write in - be a complete, utter, polite nuisance. Quote the regulations at them, remind them of their own code. Do not ever take anything for granted. Ask them to show you where does it say so, come back here or call Shelter for second opinion.
I am sorry darling, but it's an uphill struggle for a while.
It would be really good if you'd have an advocate, welfare agency caseworker or a solicitor. Try to find one through Shelter: Advice services directory or through Community Legal Service's The Directory

thanks Joa, wanted to ask, if they gave me emergency accodamation
before the eviction date, will that be classed as intentionally homeless??

also what happens once am in the emergency accomodation, will i be classed as homeless, will they give me a suitable accomadation or will they just kick me out of that after some days??

Intentional homelessness is caused by somehing that you do or not do which caused your homelessness. Local Athority can decide to offer you emergency/temporary accommodation and in the meantime investigate the reasons for your homelessness.
What happens later depends on a lot of factors; lone parent? Disability? Domestic violence? Very low income? etc etc.
Local Authority can help in other ways too; find another landlord and help with the deposit. Lots of Local Authorities operate deposit schemes etc. It costs them less to help you to rent privately then place you in temporary accommodation. Seek out your local advice agency through the Shelter Directory.

Thanks Joa, How do i apply for Homeless, i have no idea what to do?

in my circumctances is that applicable, with the Court eviction date on the 20th, and what does it involve, forms, how long before they put me down as Homeless or can you only apply after bailiffs have chucked me out?

essie, please have a good look at the Shelter website and use their directory to get personal, individual help.
Apply now. The most straightforward way is to go to your council's homeless persons unit (it may be called differently but if you call the council's switchboard they will know where to transfer you) and explain your situation. Take with you printed relevant chapters of the Homelessness Code http://www.communities.gov.uk/pub/62..._id1501625.pdf
Chapters 6-11, 14-18
Do not be afraid to ask questions like: where does it say so? On what regulations you are basing your decision?
Remember, people in authority often bluff because they are not used being contradicted. It is up to you to check what they are saying if you are not happy. It doesn't mean that they are always wrong but it does happen and you need to mind it that it doesn't happen to you.

Jess,

The previous post is spot on.

Councils hate the new guidance on homelessness. It basically says that a tenant having received notice is sufficient - court dates and eviction dates are no longer necessary.

You need to be very assertive about this. Take a friend with you for support if that will help.

Hi all
Sorry to jump in this post but thought this might help. I contactedmy local shelter who advised a homeless application. I went to my local housing options on 30th June to dothis and found the homeless caseworker there extremely helpful and understanding with my case. She gave me lots of advise and I have today recieved her descision, i have been declared officially homeless on all catagories including unintentionally homelss now I just have to wait for them to find me a home. I can't praise their support enough and I am so glad i took Shelters advise. if this can give you hope im relieved i jump in his post to help.

Thanks Guys, One really important thing thats bugging me, say on the eviction day i am still not out, can the landlord get bailiffs to get me out same day, lady at housing said on the 20th he can have bailiffs at your door, please can someone confirm if this is true, how long will the process take for landlord to get bailiffs out etc??

Need help again, if they do offer me emergency accomodation,
what is it more likely to be, Hostel or house?

I have 2 children also, the lady keeps threatning me that she will chuck me into different hostels each week or every few days, and said you might even have to share rooms with other people!

Also how long will they let me stay in the emmergancy accomodation, heard somewhere they only have to put up with you for few weeks, is this correct?


Please advice on anything around the subject
