Default Oyster Card - Penalty fare

I have not had an Oyster before and got one an part of a new deal scheme (lower fares for unemployed)

My card which had been misfunctioning on occassion failed as I got on the bus. The driver guestured for me to go, however the bus stopped for tickets inspectors a few stops after.

As the bus driver beconed me on, is this not a case on "entrapment" as the Police cannot prosecute cases where this has happened. I am planning to appeal.

Incidentially I had a small amount of credit which was only 20p short of the fare.

Any legal text I can quote?
