Default Savill Vs PC World

After looking at the site with regards to bank charges. My moral is up and I feel invincible!!! Not sure if thats the best thing or not.

3 years ago I purchased a laptop. So far its been in 4 times due to overheating. I have tried it stacked up biut still no joy. after taking it in I have been told that I am out of warrenty. So along came letter writing time. Basically explained I had taken legal advice and I now want a full refunded. I was advised by the general manager of the store that he could only offer me £200. And said I had to email someone at head office (think i was giving the run around) Tried the email did not work. So ended up going in and dumping the letter in the managers lap and said I had enough and for him to deal with.

Any ideas how I can take this forward, or does anyone know the outcomes of previous issues like this.

you won't get anywhere near what you paid for it in return as 3 year old laptop technology now is worth far less and you have had use of the product so if they were to swap it, it would be for a far cheaper model or if you had a refund it would be less the use you've had of it.

Well What Happen...

Originally when I went in I was offered £200 my the store manager. Which I said was un acceptable.
After getting names of managers I sent emails - customer service and to the managers. I assumed they where like most other email address first.surname@pcworld.co. uk And guess what it worked.

I was then offered a free repair which I turned down. They then offered me a replacement laptop of slightly better spec. Turned this down.

Then they offered me £350 which I said I was interested in but I did not believe it was enough. They finnally settled on £400. My original Laptop cost me £600.

Which I am happy with..

Hi,

I am glad I came across this thread. I have had the exact same problem with a Novatech laptop I bought less than 2 years ago.

I was under the impression I would not be entitled to any money. My mind is now officially changed, as mine is les than 2 years old!

Could you let me know what sort of legal letters you sent PC World? I would be interested in getting hold of some templates. Mine cost £750 and is completely worthless!

Under the Sale of Goods Act any product can be expected to last a 'reasonable period of time'. This isn't defined in the act and what is reasonable for one product, say a computer, will not be reasonable for another, say a bic pen. Over time various products cases have been tested in court and it is generally accepted that a substantial purchase such as a laptop should last a period of 3-4 years from purchase given reasonable use.

Remember that this refers to your statutory rights and these are over and above any warranty offered by the manufacturer.

It is also worth noting that the Sale of Goods Act refers to contract between you and the retailer, not the manufacturer and it is the retailer that has the legal obligation to repair or replace goods.

A retailer is perfectly entitled to take into account any use you have had of an item when considering offering you a refund if you have had a couple of years use from a product then the retailer can take that into account and give you a proportion of the money back. A court would almost certainly reject any claim that was not reasonable (someone demanding all or nearly all the money back).

surely if the laptop has been in for the SAME fault 4 times its actually still under the efected repairs warrenty, the work carried out is garrenteed, so that should come in to effect, if this does not help write to computer active for help

When it comes to overheating, its down to poor design of airflow. Allowing dust to get it, all they do is clean it, test it, send it back. No matter how many times you send it back, after 6 months it will be overheating again.

Why would you turn down a replcement of equal or better spec?
